CYBER MONDAY OFFICIAL RULES

1. NO PURCHASE NECESSARY.  Purchase will not increase your chances of winning.
2. How to enter: log on to JCPenney Portraits homepage (http://www.jcpportraits.com/), click on the Cyber Monday link and you will be connected to the Entry form.  Complete the Entry form with your e-mail address. Entry form must be complete and legible to be eligible to win a prize.  Limit one entry for each valid email address. Entries must be received by 5:00 p.m. CST on December 1, 2008. All entries become the property of Lifetouch Portrait Studios Inc. ("Sponsor") and will not be returned.  Sponsor not responsible for late, lost, delayed, intercepted, incomplete or misdirected entries or interruption, deletion, or failures of any line, computer, Internet or telephone network. Entries submitted in violation of the Official Rules will be void. 
3. Who may enter:  Sweepstakes is open to U.S. legal residents who are 18 years of age or older.  Employees of Sponsor, J.C. Penney Company, Inc. and (sponsors TBD)(together “Prize Sponsors”), their immediate families and household members are not eligible to win. All applicable federal, state, and local laws apply. Void outside the U.S., in Puerto Rico and where prohibited by law. 
4. Random drawing:  One Hundred Prize Winners will be randomly drawn on or about December 3, 2008.  Winners will be notified within 24 hours of the drawing by email and must reply by email with confirmation of the winner’s eligibility and publicity release within 48 hours of receipt of the notice.  Upon validation, prizes will be mailed by regular mail; all prizes will be mailed by December 12. 2008. Return of any prize notification or prize as undeliverable, or failure to timely reply to the notice will result in disqualification and prize forfeiture.
5. Conditions of entry:  By participating in this sweepstakes, you agree that none of the Sponsor or their respective shareholders, affiliated companies, directors, employees, agencies, successors or licensees will have any liability whatsoever for any injuries, losses or damages of any kind related to participation in the sweepstakes or resulting from acceptance, possession, or use of the prize. All federal, state and local taxes are the responsibility of the prize winner.
6. Prizes: Prize winners will each receive 1 - $100 gift certificate from JCPenney Portraits.  JCPenney Portraits coupons must be presented at time of sitting. Gift certificates have no expiration date and may be used toward any in-studio purchases on a single date (no credit is provided for unused portion of certificate value after initial redemption). Not valid for portrait reorders or internet purchases.   
7. Odds of winning:  Based on the number of entries received.
8. No cash or other substitutions allowed. The decisions of Sponsor are final with respect to all sweepstakes matters.
9. Limitations:  Sponsor and its affiliated companies and agents are not responsible for delays in the Sweepstakes, drawing or delivery of a prize due to strikes, acts of God, labor troubles, acts of war or terrorism, delays of commercial carriers, restraints of public authority, or for any other reason beyond its control, or for computer system, technical, hardware, software or telephone malfunctions of any kind, or for lost or unavailable network connections caused by failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications which may limit the ability to participate, for human error which may occur in the processing of entries, or any injury or damage to a participant’s or any other person’s computer related to or resulting from downloading or copying materials in this Sweepstakes.  If for any reason (including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the reasonable control of Sponsor, which affects or corrupts the administration, security, fairness, integrity, or proper conduct of this Sweepstakes), the Sweepstakes is not capable of being conducted as described in these Official Sweepstakes Rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes at any time.
